Introduction (Concept of Tourist Package)

Tour packages refer to travel and holiday experiences that encompass pre-arranged combinations of at least two of the following elements: transportation, accommodation, and non-ancillary tourist services. These packages are sold at a fixed price and extend beyond 24 hours, including at least one overnight stay.

Field of Application

The contract, which has as its object the offer of a tourist package, is understood to be governed not only by these general conditions but also by the clauses indicated in the travel documentation delivered.

Reservations

  • Reservations are received until all available places are filled. The booking request must be drawn up on the appropriate form, filled in in all its parts, and signed by the customer. Acceptance of reservations is subject to the availability of places and is understood to be completed, with the consequent conclusion of the contract, only upon written confirmation by the organizer.
  • Information about tourism packages that are not contained in contract documents, brochures, or other means of communication must be provided to the consumer by the organizers in order to fulfill their obligations regularly at an appropriate time before the start of the trip.

Payments

At the time of booking, a deposit equal to 25% of the price must be paid, including the entire registration fee, when applicable, while the balance must be paid at least 30 days before departure, provided that the reservation has been confirmed pursuant to the previous art. For bookings after the date indicated above, the entire amount must be paid at the time of booking in a single solution. Failure to pay the sums referred to above on the established dates constitutes an express termination clause such as to determine, by the organizer, the legal termination.

Price and Changes to The Tourist Package

The prices indicated in the contract can be modified up to 20 days prior to the date set for departure and only following changes in:

  • transport costs, including the fuel cost;
  • duties and taxes on certain types of tourist services, such as taxes, landing, disembarkation, or embarkation fees in ports or airports;
  • Exchange rates are applied to the package in question.

For these variations, reference will be made to the exchange rate and the cost of the services in effect on the date of publication of the program as reported therein (technical data sheet). If, before departure, the organizer is forced to significantly modify an essential element of the contract, including the price, he is required to promptly notify the consumer.

Consumer Withdrawal

The consumer can withdraw from the contract, without paying any penitential fine, only when he is notified of the modification of an essential element, pursuant to the case, if you exercise the withdrawal, you have the right, alternatively, to take advantage of another tourist package, or to be reimbursed for the part of the price already paid at the time of withdrawal. The tourist package that the consumer decides to use must be of an amount not less than that originally foreseen. If the organizer or, on his behalf, the intermediary is unable to offer a package of an equivalent or higher amount, the consumer has the right to be reimbursed for the difference.

Liability of The Organizer

The organizer is responsible for damages caused to the consumer as a result of complete or partial non-fulfillment of the contractually owed services, regardless of whether these are performed by him personally or by third-party service providers, unless he proves that the event is derived from a fact by the consumer (including initiatives, taken independently by the latter during the performance of the tourist services) or by the one not related to the provision of the services provided for in the contract, by chance, by force majeure or by circumstances that the organizer himself, after professional care, cannot reasonableness could foresee or resolve.

Assistance Obligation

The organizer is obliged to provide the consumer assistance measures imposed by the criterion of professional care solely with reference to the obligations imposed on him by law or contract. The organizer is not liable to the consumer for the intermediary travel agency’s failure to fulfill its obligations.

Complaints

Any issues arising from the execution of the contract must be reported promptly by the traveler to the organizer or their local representative, allowing for timely resolution. Additionally, the traveler must submit a complaint via registered mail with acknowledgment of receipt to the Organizer and the Seller no later than ten working days from the date of their return to the departure place.

In case of problems during the trip, the traveler must contact the organizer directly or through the intermediary agency to seek a prompt and fair solution. If the traveler decides to terminate their stay and believes they are entitled to a refund, they must obtain a written declaration from the respective establishment, clearly certifying the right to reimbursement.

While Rathore Tour and Travels have taken great care in compiling this catalog to ensure accurate descriptions, it cannot be held responsible for any changes that may occur subsequently regarding additional services. It should also be noted that certain facilities offered by tourist complexes, such as swimming pools, discos, markets, entertainment, mini clubs, sports courses, etc., may not be operational.

Jurisdiction

Any disputes arising from this contract shall be subject to the exclusive jurisdiction of the court located in the Tour Operator’s jurisdiction.

In compliance with current legislation on personal data protection, the processing of personal data is carried out with accuracy, transparency, and lawful purposes, ensuring confidentiality and respecting individual rights.
